This Privacy Policy is only for the Foreflight Insurance Agency, LLC and the services it provides. The terms “Foreflight” “we,” “our”, and “us” include Foreflight Insurance Agency, LLC and, where applicable, our affiliates and subsidiaries. This Privacy Policy explains how we may collect, use, and disclose information we obtain through the “Service” (the aviation insurance brokerage services).

IMPORTANT NOTE ON OUR ROLE: Foreflight acts solely as an insurance broker connecting you (the Applicant or Insured) with insurers. We do not underwrite insurance. We collect and process your information to facilitate the application and quoting process on behalf of insurers.

By accessing or using the Service, you expressly consent to our collection, use, and disclosure of your Personal Information in accordance with the terms and conditions of this Privacy Policy.

Categories of Personal Data Processed by Foreflight

PERSONAL DATA THAT IS PROCESSED FOR INSURANCE QUOTING & ACCOUNT MANAGEMENT:

When you request an insurance quote through ForeFlight, we collect specific information required by insurance underwriters to assess risk and provide accurate quotes, together “Personal Information”. This includes:

  • Demographic & Contact Information: Name, age or date of birth, and home address.
  • Pilot History & Certification: Pilot license details, history of FAA violations, and certificate actions or suspensions.
  • Insurance & Loss History: Prior aviation insurance claims, accidents, incidents, and loss history.
  • Legal & Driving Record: Self-reported history of motor vehicle driving violations (including DUI/DWI), driver’s license suspensions, and felony convictions.
  • Medical Information: Self-reported medical data specifically relevant to pilot fitness and FAA medical certification status.
  • Safety Devices: Presence of certain safety devices in the insured aircraft. No data from safety devices is shared with the underwriter, only the presence of the safety device.
PERSONAL DATA THAT IS PROCESSED WHEN YOU MAKE A PAYMENT:

When you make payments through the Service, you may need to provide financial account information, such as your credit card number or bank account information, to our third-party payment processors for the performance of the contractual obligations.

PERSONAL DATA THAT IS PROCESSED WHEN YOU ADD AN AIRCRAFT TO YOUR PROFILE:

When you add an aircraft to your account, we may ask for additional information, such as the make, model, series name, tail number, year, and serial number of the aircraft.

PERSONAL DATA THAT IS PROCESSED WHEN YOU COMMUNICATE WITH FOREFLIGHT:

When you interact with our customer support representatives, we collect Personal Information, such as your name, mailing address, phone number, email address, and contact preferences and may associate support information with your account data.

PURPOSES AND LEGAL GROUNDS: 

(a) Foreflight processes this Personal Information strictly for the purpose of acting as an insurance broker. This information is necessary to solicit quotes from insurers or their representatives on your behalf. 

(b) The legal ground for processing this data is the performance of a contract (preparing your insurance quote) and legitimate interest (facilitating the underwriting process).

(c) By giving Foreflight your email address, you consent to receiving marketing information and newsletters. The legal ground for processing your email address for this purpose is your consent. You may opt-out at any time.

(d) Foreflight also processes your email address to associate it with your account when you interact with our customer support representatives.

(e) Foreflight processes your Personal Information to prevent fraud and abuse. The legal grounds for this processing are a legitimate interest in protecting our Services and the performance of the contract. 

This information is processed to facilitate the insurance quoting process. The legal grounds are our legitimate interest in providing accurate insurance quotes based on your specific aircraft.

Categories of Recipients of Personal Data

INSURERS:

As a broker, we disclose your personal data, aircraft details, and pilot information to insurers or their representatives for the specific purpose of obtaining quotes, binding coverage, and servicing your insurance policy. We do not share this information with any other parties.

OTHER SERVICE PROVIDERS:

Foreflight uses cloud services from third parties to assist in sending emails and to analyze the use and performance of our products.

OTHER DISCLOSURES:

We may disclose personal data about you to others: (a) if we have your valid consent to do so; (b) to comply with a valid subpoena, legal order, court order, legal process, or other legal obligation; (c) to enforce any of our terms and conditions or policies; or (d) as necessary to pursue available legal remedies or defend legal claims.

Merger, Sale, or Other Asset Transfers

If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of assets, or transition of service to another provider, your information may be sold or transferred as part of such a transaction as permitted by law and/or contract.

Transfers of Personal Data

ForeFlight is based in the United States. Your personal data will be collected and stored on ForeFlight servers in the United States.

Information Security

We take steps to ensure that your information is treated securely and in accordance with this Privacy Policy. Unfortunately, the Internet cannot be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any information you provide to us.

Children’s Privacy

We do not knowingly collect, maintain, or use Personal Information from children under 13 years of age.

Marketing

We do not rent, sell, or share Personal Information about you with other people or nonaffiliated companies for their direct marketing purposes, unless we have your permission.

Addendum 1: State Specific Rights

Your Rights in California (CCPA)

This section applies solely to the personal data of users who reside in the State of California.

  • Access and Portability: You have the right to request that Foreflight disclose certain information to you about our collection and use of your personal information over the past 12 months.
  • Deletion: You have the right to request that Foreflight delete any of your personal information that we collected from you and retained, subject to certain exceptions.
  • Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights.
  • Do Not Sell: We do not sell Personal Information.
