SUPPLEMENTAL END USER TERMS AND CONDITIONS

1. ACCEPTANCE AND RELATIONSHIP TO THE FOREFLIGHT EULA. These Supplemental End User Terms and Conditions (these “Connector Terms”) govern your access to and use of the ForeFlight Model Context Protocol connector and related interface that enables ForeFlight data and functionality to be accessed within OpenAI’s ChatGPT and related OpenAI products (the “Connector”). The Connector is provided by ForeFlight, LLC and its affiliates (“ForeFlight,” “we,” “us,” or “our”).

These Connector Terms supplement, and are made a part of, the ForeFlight Terms of Use and End User License Agreement (the “EULA”), which is incorporated into these Connector Terms by reference. The Connector is part of the “Service” as defined in the EULA. By enabling, connecting, or using the Connector, you agree to these Connector Terms and you reaffirm your agreement to the EULA and the ForeFlight Privacy Policy.

In the event of a conflict between these Connector Terms and the EULA with respect to the Connector specifically, these Connector Terms control. In all other respects the EULA remains in full force and effect. Capitalized terms not defined here have the meanings given in the EULA.

2. DEFINITIONS. The following terms have the meanings set out below:

  • “ChatGPT” means the ChatGPT service and related products operated by OpenAI, OpenCanvas, L.L.C. and its affiliates (“OpenAI”).
  • “AI Output” means any text, summary, recommendation, calculation, route, or other content generated by ChatGPT or any other AI system, including content generated using data or functionality made available through the Connector.
  • “ForeFlight Data” means data, information, and functionality made available to you or to ChatGPT through the Connector, including flight, route, logbook, aircraft, airport, weather, NOTAM, and performance information.
  • “Input” means any prompt, instruction, file, or other content you submit to ChatGPT in connection with the Connector.

3. DESCRIPTION OF THE CONNECTOR. The Connector allows you to connect your ForeFlight account to ChatGPT so that, at your direction, ChatGPT may request and receive ForeFlight Data and may invoke certain ForeFlight functions on your behalf (for example, retrieving airport, weather, or NOTAM information, listing or drafting flights or logbook entries, or requesting route and performance information). The Connector is a convenience and informational tool only. ForeFlight may add, change, suspend, or remove Connector features at any time in accordance with the EULA.

4. NOT FOR FLIGHT — CRITICAL SAFETY NOTICE. This is the most important section of these Connector Terms and applies to all use of the Connector and all AI Output.

THE CONNECTOR AND ALL AI OUTPUT ARE PROVIDED FOR GENERAL INFORMATION, CONVENIENCE, AND SITUATIONAL-AWARENESS PURPOSES ONLY. THEY ARE NOT FOR NAVIGATION AND ARE NOT TO BE USED AS A SOURCE OF REAL-TIME OR OPERATIONAL FLIGHT INFORMATION.

DO NOT RELY ON THE CONNECTOR OR AI OUTPUT FOR FLIGHT PLANNING, DISPATCH, IN-FLIGHT DECISION-MAKING, NAVIGATION, WEATHER, NOTAMs, FUEL, PERFORMANCE, OR ANY OTHER SAFETY-OF-FLIGHT OR OPERATIONAL PURPOSE.

AI MAKES MISTAKES. AI OUTPUT MAY BE INACCURATE, INCOMPLETE, OUTDATED, OR FABRICATED, AND MAY NOT REFLECT CURRENT CONDITIONS. ALWAYS VERIFY ALL INFORMATION AGAINST OFFICIAL SOURCES AND THE CERTIFIED FOREFLIGHT APPLICATION BEFORE ANY FLIGHT-RELATED USE.

You acknowledge and agree that:

  • ForeFlight Data delivered through the Connector may be delayed, cached, summarized, reformatted, or otherwise altered, and is not guaranteed to be current, accurate, complete, or available in real time.
  • The Connector is not a certified electronic flight bag (EFB) function, is not a substitute for the certified ForeFlight application or official government sources, and must not be used as certified in-flight reference information.
  • You must always obtain current weather, NOTAMs, charts, and aeronautical information from official sources and the certified ForeFlight application, and you must independently confirm any information before relying on it.
  • Nothing produced by the Connector or by ChatGPT relieves you of your responsibilities as pilot in command or operator, or of your obligation to comply with all applicable aviation regulations and operating rules.

5. PILOT-IN-COMMAND AND USER RESPONSIBILITY. You are solely responsible for all decisions and actions taken in connection with any flight or aviation activity, regardless of any AI Output or ForeFlight Data accessed through the Connector. The pilot in command and operator retain ultimate responsibility for the safe conduct of every flight, including the duty to verify all data against official and certified sources and to exercise their own best judgment. The Connector and AI Output must never be substituted for your own judgment or for official sources.

6. AI OUTPUT — NATURE AND LIMITATIONS. ChatGPT is a generative artificial intelligence system that produces probabilistic output. AI Output can be wrong, misleading, internally inconsistent, or entirely fabricated, even when it appears confident or authoritative. ForeFlight does not create, control, review, endorse, or guarantee any AI Output, including AI Output generated using ForeFlight Data. ForeFlight is not responsible for how ChatGPT interprets, processes, summarizes, or presents ForeFlight Data, or for any AI Output. You are responsible for evaluating the accuracy, completeness, and suitability of any AI Output before relying on it for any purpose.

7. CHATGPT IS A THIRD-PARTY SERVICE. ChatGPT and OpenAI are independent third parties and are not owned, operated, or controlled by ForeFlight. ForeFlight is not affiliated with OpenAI, and your use of ChatGPT is governed by OpenAI’s own terms of use and privacy policy, which form a separate agreement between you and OpenAI. ChatGPT is a “Third Party Service” for purposes of the EULA. As provided in the EULA, ForeFlight does not control and is not responsible for any Third Party Service, and you irrevocably waive and release any claim against ForeFlight arising out of or relating to ChatGPT, OpenAI, or your use of them. You are responsible for any fees charged by OpenAI or your carrier.

8. AUTHORIZATION, ACCOUNTS, AND SECURITY. You represent, acknowledge, and agree that:

  • You must have a valid ForeFlight subscription and account and a valid ChatGPT account to use the Connector, and you must comply with the eligibility and account requirements of the EULA, including that you are at least 18 years of age.
  • By enabling the Connector, you authorize ForeFlight to make ForeFlight Data and functionality associated with your account available to ChatGPT at your direction, and you authorize the exchange of data between ForeFlight and OpenAI necessary to operate the Connector.
  • You are solely responsible for maintaining the confidentiality and security of your ForeFlight and ChatGPT credentials and access tokens, and for all activity that occurs through your connected accounts. You may disconnect or revoke the Connector’s access at any time through your account settings.
  • You may not share, resell, sublicense, or provide access to the Connector except as permitted by the EULA, and you may not use the Connector to access data belonging to any account you are not authorized to use.

9. DATA SHARING, PRIVACY, AND AI PROCESSING. When you use the Connector, ForeFlight Data and your Inputs are transmitted to and processed by OpenAI in order to generate AI Output. This means information from your ForeFlight account that you choose to access through the Connector — which may include flight, route, logbook, aircraft, and location-related information — will be disclosed to OpenAI and handled under OpenAI’s terms and privacy policy, including any settings governing whether your data may be used to train or improve OpenAI’s models. ForeFlight does not control OpenAI’s data practices.

ForeFlight’s collection and use of your information is described in the ForeFlight Privacy Policy, which is incorporated by reference. You are responsible for the data you choose to share through the Connector and should not transmit information through the Connector that you do not wish to disclose to OpenAI. Do not submit through the Connector any data subject to export control, third-party confidentiality obligations, or other restrictions that would prohibit its disclosure to OpenAI.

10. THIRD-PARTY AND LICENSED DATA. ForeFlight Data may include data owned or licensed by third parties, including Jeppesen and other data suppliers identified in the EULA. Such third-party data remains subject to the additional terms, restrictions, and disclaimers set forth in the EULA, including the Jeppesen Additional Terms and Conditions. Without limiting those terms, you may not use the Connector to copy, redistribute, sublicense, reverse engineer, or create derivative works from third-party data, and third-party data accessed through the Connector is provided “as is,” is not for navigation, and is for reference and situational awareness only. The applicable third-party licensors are third-party beneficiaries of these Connector Terms with respect to their data.

11. ACCEPTABLE USE. In addition to the prohibited conduct provisions of the EULA, you agree not to:

  • Use the Connector or AI Output for navigation, dispatch, real-time operational decision-making, or any safety-of-flight purpose;
  • Use the Connector in connection with any activity where inaccurate, delayed, or unavailable data could lead to death, personal injury, or property or environmental damage;
  • Misrepresent AI Output or ForeFlight Data as certified, official, or verified information;
  • Use the Connector to build, train, or benchmark a competing product or dataset, or to scrape, bulk-export, or redistribute ForeFlight Data (see Section 12);
  • Circumvent or interfere with rate limits, security, or access controls, or use the Connector in violation of the EULA, OpenAI’s terms, or applicable law, including export-control and sanctions laws.

12. NO AI TRAINING, MODEL DISTILLATION, OR DATA EXTRACTION. You may not, and may not permit, direct, or enable any third party (including any AI platform, model provider, developer, or agent acting on your behalf) to, use the Connector, ForeFlight Data, or AI Output, in whole or in part, to:

  • train, fine-tune, pre-train, retrain, calibrate, validate, evaluate, benchmark, ground, or otherwise develop or improve any artificial intelligence, machine learning, large language, foundation, or other model, system, or algorithm;
  • perform model distillation or knowledge distillation, or otherwise create, derive, reconstruct, or extract any model, model weights, parameters, embeddings, or any substitute, derivative, or competing model, dataset, or service from ForeFlight Data or AI Output;
  • create, augment, label, or contribute to any dataset, corpus, index, vector store, or knowledge base that is intended for, or capable of, training, fine-tuning, or improving any model or system; or
  • systematically access, scrape, crawl, harvest, cache, store, or bulk-export ForeFlight Data, or reconstruct, approximate, or re-identify ForeFlight Data or any ForeFlight database, in each case beyond the limited, account-specific, query-by-query use expressly authorized by these Connector Terms.

To the extent any AI platform you use (including ChatGPT) offers controls governing whether your inputs and connected data may be used to train or improve its models, you must enable those controls so that ForeFlight Data and AI Output are not used for any such purpose, and you represent that you have done so. You acknowledge that ForeFlight makes ForeFlight Data available through the Connector solely for your individual, interactive use, and not for any model-development, training, or data-aggregation purpose. All ForeFlight Data, and all intellectual property, proprietary, and database rights in it, remain the exclusive property of ForeFlight and its licensors, and no license or right to use ForeFlight Data or AI Output for any purpose described in this Section is granted by implication, estoppel, or otherwise. The restrictions in this Section are in addition to the restrictions in the EULA (including the prohibitions on reverse engineering and on creating derivative works), apply to any third-party data accessed through the Connector for the benefit of its licensors, and survive termination.

13. DISCLAIMERS; NO WARRANTY. THE CONNECTOR, FOREFLIGHT DATA MADE AVAILABLE THROUGH THE CONNECTOR, AND ALL AI OUTPUT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, FOREFLIGHT AND THE FOREFLIGHT ENTITIES DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TIMELINESS, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE CONNECTOR WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT FOREFLIGHT DATA OR AI OUTPUT WILL BE ACCURATE, COMPLETE, CURRENT, OR RELIABLE.

WITHOUT LIMITING THE FOREGOING, FOREFLIGHT MAKES NO WARRANTY REGARDING ANY AI OUTPUT OR REGARDING CHATGPT OR ANY OTHER THIRD PARTY SERVICE. THE DISCLAIMERS AND LIMITATIONS IN THE EULA, INCLUDING THE AVIATION-DATA, “NOT FOR NAVIGATION,” AND THIRD-PARTY DATA DISCLAIMERS, APPLY FULLY TO THE CONNECTOR AND ARE INCORPORATED HERE.

14. LIMITATION OF LIABILITY. TO THE FULLEST EXTENT PERMITTED BY LAW, THE FOREFLIGHT ENTITIES SHALL HAVE NO LIABILITY, WHETHER ARISING IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, FOR ANY LOSS OR DAMAGE OF ANY KIND ARISING OUT OF OR RELATING TO THE CONNECTOR, FOREFLIGHT DATA ACCESSED THROUGH THE CONNECTOR, ANY AI OUTPUT, OR YOUR USE OF OR RELIANCE ON ANY OF THE FOREGOING, INCLUDING ANY LOSS OF USE, REVENUE, OR PROFIT, LOSS OF OR DAMAGE TO DATA, OR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, AND INCLUDING ANY DAMAGES ARISING FROM DEATH, PERSONAL INJURY, OR PROPERTY DAMAGE TO THE EXTENT PERMITTED BY LAW. THIS LIMITATION APPLIES EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE AND IS IN ADDITION TO, AND DOES NOT LIMIT, THE LIMITATIONS OF LIABILITY SET FORTH IN THE EULA.

15. INDEMNIFICATION. You agree to indemnify, defend, and hold harmless the ForeFlight Entities from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Connector or any AI Output; (b) your reliance on the Connector, ForeFlight Data, or AI Output for any flight, navigation, or operational purpose; (c) data you transmit through the Connector or disclose to OpenAI; or (d) your violation of these Connector Terms, the EULA, OpenAI’s terms, or applicable law. This obligation is in addition to the indemnification provisions of the EULA.

16. TERM AND TERMINATION. These Connector Terms are effective until terminated. Your rights under these Connector Terms terminate automatically and without notice if you fail to comply with them or with the EULA. ForeFlight may suspend, discontinue, or terminate the Connector or your access to it at any time, for any reason or no reason, with or without notice, in accordance with the EULA. You may stop using the Connector and revoke its access at any time. Sections 4 through 15 and 17 through 19 survive any termination.

17. CHANGES TO THESE CONNECTOR TERMS. ForeFlight may modify these Connector Terms from time to time in accordance with the modification provisions of the EULA. Material changes will be communicated to you, and your continued use of the Connector after changes become effective constitutes acceptance. Disputes will be resolved under the version of these Connector Terms in effect when the dispute arose.

18. GOVERNING LAW; FORUM; WAIVERS. These Connector Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-laws rules, and the United Nations Convention on Contracts for the International Sale of Goods does not apply. You and ForeFlight agree that the exclusive jurisdiction and venue for any dispute arising out of or relating to these Connector Terms or the Connector will be the state and federal courts located in Harris County, Texas, consistent with the EULA. YOU AND FOREFLIGHT EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION, in each case as further set forth in the EULA. Third-party data licensors’ own governing-law and dispute-resolution terms continue to apply to their data as provided in the EULA.

19. GENERAL. These Connector Terms, together with the EULA and the ForeFlight Privacy Policy, constitute the entire agreement between you and ForeFlight regarding the Connector. If any provision is held unenforceable, the remaining provisions remain in effect. ForeFlight’s failure to enforce any provision is not a waiver. You may not assign these Connector Terms without ForeFlight’s consent; ForeFlight may assign them. These Connector Terms do not create any agency, partnership, or joint venture between you and ForeFlight.
